Consultation on the draft 'Recreational Craft Regulations, 2015'

This information is of great importance and interest of all those connected to Marine sports and business. Attached please find an explanatory note  and a draft text of a new legal notice  which will substitute the Recreational Craft Regulations of 2005. The proposed draft legal notice transposes Directive 2013/53/EU of the European Parliament and of the Council of 20 November 2013 on recreational craft and personal watercraft and repealing Directive 94/25/EC.

The proposed regulations relate to the design, manufacturing and placing on the market of the following products:

• recreational craft and partly completed recreational craft;
• personal watercraft and partly completed personal watercraft;
• the following components when placed on the Union market separately:
o Ignition-protected equipment for inboard and stern drive petrol engines and petrol tank spaces;
o Start-in-gear protection devices for outboard engines;
o Steering wheels, steering mechanisms and cable assemblies;
o Fuel tanks intended for fixed installations and fuel hoses;
o Prefabricated hatches, and port lights.
• propulsion engines which are installed or specifically intended for installation on or in watercraft;
• propulsion engines installed on or in watercraft that are subject to a major engine modification;
• watercraft that are subject to major craft conversion.

Manufacturers, importers and distributors of such products are therefore advised to carefully consider the attached draft regulations and in particular the respective obligations stipulated therein.

Any comments anybody may have on the draft text of the proposed Legal Notice are to be sent to the Malta Competition and Consumer Affairs Authority by Thursday, 19th November 2015.
